Does this package come wrapped in plastic?

Yes it does but its shipped in a material made from our precious trees and transportsed in something that consumes fossil fuel. I wouldn't be too concerned about if its packaged in plastic.

will a magnet stick to these?

Stainless is non magnetic so no!

Will this work in a 40 oz?

It depends on the height of the 40 oz cup. These straws are 10.5 inches tall, as stated in the description, and you want an inch or more extended out of the top of the cup you are going to use, so you'll have to determine that yourself.

Can it be used with hot beverages?

yes, but I would be very careful, and they being thin metal will take on the temp of the hot beverage.
