No, the one I have is 23" tall. Wherever you are purchasing it from check to see if they have different sizes. I have purchased other angels and had the same questions. There have been mistakes in the posting of prices so there may be a 40" one available but it depends on the price listed on it.

Can this be used outside ?

You could. I have medium size. I was going to place her outside with others but decided to keep her inside because she is outstanding.

I really don't know as my angel is an inside sculpture. I see it everyday rain or shine and enjoy its beauty

Did anyone else's statue come with alot of imperfections?

Mine came perfect, however thr fountain I purchased from them had manufacturing defects but I fixed it with a shim. It's still not right, but better than it was. It wasn't worth thr hassle of sending it back since it went by freight. The statue though is gorgeous
