No it's not solvent based so it didn't have a strong smell like the solvent based ones

Could you apply this to a melamine finish if was sanded first

The dye needs to be absorbed by the surface to which it is applied otherwise it will wipe off, so I would say the answer is no.

The Jacobean Oak should be extremely dark brown, but it doesn't look like that on tin. What us colour like please?

It's a while since I've used this, but as I remember it is very dark. Try a test on a scrap piece of wood of a similar colour to your workpiece before going ahead. If it's till too light, apply a further coat of dye. Good luck.
