Can I wash this flag?

I haven't washed mine yet, but I see no reason to worry. It is polyester so should be fine. I would air-dry though. Heated dryer might cause it to deform/shrink due to heat.

why is it called a Palestinian flag when its the Baath party flag?

It is not the Ba'ath party flag, although the colors and design of the two are seemingly identical. But, the Ba'ath party flag is square in shape, like the flag of Switzerland. The Ba'ath Party flag's red, white, green and black colors that are also present in the State of Palestine's flag are the Pan-Arab colors, commonly found in flags representing Arab countries and various Arab organizations and entities. The Pan-Arab colors were first combined to symbolize the rise of the Arab Revolt in 1916 when Arab nationalists championed to break free against the Ottoman Empire during World War 1. The Flag of the Arab Revolt looks almost identical to the flag of Palestine as well. That is why the Ba'ath Party Flag and the Palestinian flag look so like, along with the flags of Jordan, Kuwait, Sudan, and other Arab nations.
