This book gives an extremely clear and readable account of the rise of plea bargaining in the 1800s, and uses this data to support a compelling argument for HOW and WHY plea bargaining has succeeded: because it satisfies the incentives of prosecutors, judges, and in many cases, defendants. Anyone interested in either the historical realities of plea bargaining, or the possibilities for future reforms, needs to understand this basic and powerful dynamic. Recommended not just to lawyers or judges, but anyone interested in understanding plea bargaining as it actually takes place in the real world. Note: there is not much discussion here of current practices (besides a chapter on the Federal Sentencing Guidelines), so you may want to look elsewhere for the basics if you're completely unfamiliar with the topic.
