It is normal to see a little spark at first due the the brushes in the motor. Do not operate power tools in explosive atmospheres, such as in the presence of flammable liquids, gases or dust. Power tools create sparks which may ignite the dust or fumes.

Can the drill use a higher voltage battery? Do batteries have to be black & decker to work with the drill?

Yes. Some suppliers make knock-offs of B&D batteries, and there are some that may be more powerful. But it has to be an exact duplicate of the surface, to fit the slots of the drill. Most alternative batteries will tell you what models they fit.
